(i) If Apple terminates this plan, Apple will refund nevada consumers the undeserved portion of the purchase price. Apple may deduct the outstanding amount in your account from the purchase price amount that is not earned when calculating the refund amount. If Apple terminates a contract in accordance with NRS 690C.270, it cannot charge a cancellation fee. This Agreement (the “Plan”) governs the services provided by Apple under the above plans and includes the terms of this document, confirmation of your plan (“Plan Confirmation”) and original proof of purchase of your Plan. Your plan confirmation will be provided to you at the time of purchase. If you purchased your plan from Apple, you can get a copy of your plan confirmation by going mysupport.apple.com/products. If you have any questions about your AppleCare+ coverage, you may write to or call the administrator/debtor at the address or phone number included in this Agreement. Coverage begins with the purchase of the plan. “Plan Term” means the date on which your Plan begins in accordance with the preceding sentence and, unless cancelled, ends on the date specified in your Plan Confirmation.
Your plan confirmation will be provided to you at or around the time of purchase or will be sent to you automatically thereafter. If you purchased your plan from Apple, you can get a copy of your plan confirmation by following the instructions and entering the serial number of your covered device at www.apple.com/support/applecare/view. You also have the right to choose a refund or replacement for major defects in the goods. If a defect in the goods or services does not constitute a material defect, you have the right to have the defect repaired within a reasonable time. If this does not happen, you are entitled to a refund of the goods and the cancellation of service contracts and a refund of an unused part. You are also entitled to compensation for any other reasonably foreseeable loss or damage resulting from a failure of the good or service. In the event that you do not receive satisfaction under this Agreement, you may contact the New Hampshire Insurance Department, by mail at 21 South Fruit Street, Suite 14, Concord NH 03301, or by calling Consumer Support at 800-852-3416. (a) Apple may subcontract or assign the performance of its obligations to a third party, but will not be released from its obligations to you. If Apple cancels this plan, Apple will refund Nevada consumers the portion of the purchase price that is not earned. If Apple terminates a contract in accordance with NRS 690C.270, it cannot charge a cancellation fee. Unless otherwise specified in this section, a Nevada resident who is the original purchaser of this Plan who submits a written request to Apple to cancel the Plan in accordance with the terms of the Plan will receive a refund of the portion of the purchase price of the Plan that is not earned, and Apple will not deduct the value of the Service provided. If you request termination of this Plan after the first thirty (30) days of the Plan term, Apple will not charge a cancellation fee or deduct the value of the Service provided. If Apple calculates the amount of a refund in accordance with subsection (ii), apple may deduct an outstanding account balance from the portion of the purchase price that is not earned. AppleCare Service Company, Inc. supports this plan for Nevada residents through its full trust and recognition. The Provider may terminate this Plan without notice for non-payment, misrepresentation or material breach of any obligation of the Owner with respect to the Covered Device or its use. Please note that if you use the Service under this Plan in a country other than your country of purchase, the Service Fee must be paid in the currency of that country and at the rate applicable in that country – for more information, including applicable fees by country, please visit the AppleCare+ Support website at apple.com/legal/sales-support/applecare/applecareplus/. 5.13 Subcontractors.
Apple may subcontract to other service providers for the service of your product. For residents of Europe: Before entering into your contract with Apple, you will receive correct information about the main characteristics of the goods or services, as well as the price and shipping costs of the goods or services, all taxes included. If you cancel this plan in accordance with these Terms and Conditions and Apple does not refund the purchase price to you within the time specified below, Apple will pay you a penalty of ten percent (10%) per month for the outstanding amount due and due. For residents of California, New York, Missouri and Washington, Apple will issue a refund within thirty (30) days. For residents of Alabama, Arkansas, Colorado, Hawaii, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, South Carolina, Texas and Wyoming, Apple will issue a refund within forty-five (45) days. For residents of New Mexico, Apple offers a refund within sixty (60) days. The right to cancel and receive this penalty applies only to the original owner of the contract and cannot be transferred or assigned. Supplier`s obligations under this Service Agreement are supported by the full trust and solvency of Supplier, AppleCare Service Company, Inc. .
